The following terms and conditions apply to all prize draws operated by the Promoters (as defined below) on www.wavemakerseveryvoice.co.uk (the “Site”).
The promoters are: (i) Wavemaker Limited, registered in England under company number 04078547 with a registered office at Sea Containers, 18 Upper Ground, London SE1 9ET, United Kingdom; and (ii) STRAT7 Researchbods, a division of STRAT7 Limited, registered in England under company number 07642707 with a registered office at 11 Soho Street, London, W1D 3AD, (together the “Promoters”). The Promoters shall manage and administer the prize draws on the Site.
These terms and conditions apply in addition to any specific terms and conditions which may be posted in connection with the prize draw on the Site and/or otherwise communicated to you by either of the Promoters (“Specific Terms”). Together these terms and conditions and the Specific Terms shall be referred to as the “Terms and Conditions”. To the extent that there is any inconsistency between these terms and conditions and the Specific Terms, the Specific Terms will prevail.
By taking part in a prize draw, you confirm that you have read and understood the Terms and Conditions and agree to be bound by them. If you do not agree with any of the Terms and Conditions, then you should not participate.
The Terms and Conditions may be amended at any time without prior notice. The updated Terms and Conditions will be posted on the Site. It is your responsibility to ensure you review the current Terms and Conditions prior to entering any prize draw.
There are other important terms that may apply to you. These include:
Entrants must be: (i) a registered member of the ‘Wavemaker’s Every Voice’ online research community (each a “Member” and together the “Members”); (ii) residents of the United Kingdom; and (iii) aged 18 years or over.
The following persons are not eligible to enter: (i) employees or workers of the Promoters, or the employees or workers of any company in their respective groups; (ii) employees or workers of any organisation involved in the operation or administration of the prize draw including, without limitation, prize suppliers and advertising agencies; and (iii) members of the persons identified in part (i) and part (ii)’s immediate families (including any live-in partners). Any such entries are invalid.
The Promoters reserve the right in their sole discretion to ask for evidence to verify the age, residence, identity and/or eligibility of an entrant at any time, and to use any channels and methods available to carry out checks of any details provided. The Promoters may withhold delivery of a prize until it has received such evidence from the winner and failure to provide such evidence to the Promoters’ reasonable satisfaction in a timely manner may result in an entry being void or forfeiture of the prize. The Promoters’ decision as to whether an entrant (or their entry) is eligible for a prize draw is final and the Promoters are not obliged to provide any reasons for disqualification.
The start date and closing date and time for entries will be as indicated in the Specific Terms.
To enter a prize draw, entrants must follow the instructions provided by the Promoters, including without limitation those specified in the Specific Terms. Please note that entrants may be automatically entered into a prize draw when they complete any of the eligible research tasks (e.g. surveys, polls or forum discussions) the Promoters invite them to participate in, if so indicated in the Specific Terms posted on the Site or otherwise communicated by the Promoters (e.g. as part of the invitation to participate in the research task). You may only submit one entry per prize draw. Entries over the maximum number of entries will be void. No payment will be necessary to enter any prize draw operated on the Site.
Any entries received before the prize draw opens or after the closing date and time will not be counted.
Any entries which are incomplete, without all the required information, incomprehensible or illegible, incorrectly submitted, lost, damaged in any way, or which are not received by the Promoters or are not otherwise in accordance with the Terms and Conditions, are invalid and will be discounted.
In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the prize draw, the decision of the Promoters shall be final.
Where entrants are required to submit a contribution to the Site or upload any content as part of their entry such as any text (including, for instance, on any forums or on any classified pages), photographs, graphics, video or audio to the Site (“Contribution”), entrants agree that the Promoters shall have the right to use such Content in accordance with the Site’s Terms and Conditions of Use. Reference to ‘Contribution’ in such Terms and Conditions of Use includes all entries submitted by the entrants.
The prize for each prize draw is as specified in the Specific Terms posted on the Site or otherwise communicated by the Promoters (e.g. as part of an invitation to participate in a research task). Unless otherwise stated in the Specific Terms, each entrant is limited to winning one prize per prize draw. Each prize is subject to availability and to winner confirmation, i.e. the Promoters have managed to contact the winner and confirm eligibility.
Where the prize is a voucher (which may be provided in the form of a unique voucher code or otherwise), such voucher may only be redeemed by the winner and the value of the voucher will be in pounds sterling. Such voucher shall be sent to the winner via the Site or by email and cannot be given to any third party. Use of such voucher may also be subject to the terms and conditions of the issuer of the voucher (e.g. Amazon, Debenhams, House of Fraser, iTunes, John Lewis, M&S, TK Maxx or Waterstones). The Promoters, prize provider(s) and/or the issuer of the voucher reserve the right to refuse to accept vouchers which are deemed to have been tampered with, defaced, duplicated, damaged or which otherwise are suspected to be affected by fraud or which have been lost or stolen following delivery. The Promoters are not responsible for any damage or loss to a prize caused by any third party. The winner is responsible for any costs or expenses involved in claiming or using the prize other than those that are expressly stated above as being included as part of the prize.
No cash equivalent (where applicable) or alternative prize will be given at the request of the winner and the prize is non-transferable and non-exchangeable. However, the Promoters reserve the right to change the prize or any part of the prize to an alternative of equal or greater value for any reason in their sole discretion, including without limitation due to circumstances beyond their control or if the prize or any part of the prize becomes unavailable. If for any reason the winner chooses not to take up the prize or any part of the prize, the Promoters reserve the right to ask the winner to confirm this in writing and the Promoters will be able to retain or dispose of the prize (or part of the prize) at their own discretion.
The Promoters may refuse to provide a prize, or seek its recovery, in the event of non-entitlement under the Terms and Conditions or an entrant's breach of the Terms and Conditions, fraud or dishonesty.
The Promoters or prize provider(s) endeavour to deliver the prize to the winner within twenty-eight (28) days from the date the winner is notified that they have won, unless stated otherwise in the Specific Terms. The Promoters or prize provider(s) will not be liable where a prize has been lost or stolen following delivery and such prize will not be replaced.
The number of winners for each prize draw is as specified in the Specific Terms posted on the Site or otherwise communicated by the Promoters (e.g. as part of an invitation to participate in a research task).
Prize draws will take place within one week of the closing date and time for entry, unless otherwise specified in the Specific Terms.
Unless stated otherwise in the Specific Terms, the winner will be the first entry drawn at random from all valid entries, subject to eligibility and winner confirmation.
Unless otherwise stated in the Specific Terms, the winner will be contacted via the Site or by email within 14 days from the draw date, unless otherwise indicated in the Specific Terms.
If the winner fails to respond to the communication from the Promoters within 30 days of the communication being sent, or if the winner fails to meet any of the eligibility requirements or is otherwise unable to comply with the Terms and Conditions, this may result in forfeiture of the prize and the Promoters reserve the right to disqualify that entrant (without liability to that entrant) and offer the prize to the next eligible entrant and thereafter until a winner is found.
The winner is required to comply with all instructions and requirements as may be provided by the Promoters, prize provider(s) and/or their agents to receive and/or take up the prize. The Promoters will not be liable to the winner or any other persons where they fail to comply with such instructions and/or requirements, and such failure may result in forfeiture of the prize (without liability to the entrant).
The Promoters are committed to operating prize draws fairly and to preventing abuse of their systems.
For this reason, the Promoters reserve the right to disqualify and/or discount entries if it has reasonable grounds to suspect, at their sole discretion, having regard to all the circumstances and information available at the relevant time, any of the following:
The Promoters do not accept responsibility in the event that any entry is lost, delayed or not properly received, registered or recorded or for any undelivered prize draw entries or for any disruption, delay or misdirection of such entries.
The Promoters do not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by you as an entrant howsoever arising from participating in a prize draw or from accepting any prize, whether due to any error, omission by the Promoters, or their employees, agents or others or by any other cause.
The Promoters reserve the right to suspend and/or amend any element of a prize draw for reasons beyond their reasonable control. The Promoters are not responsible for any loss or damage caused to you as a result of any such occurrence.
Nothing in the Terms and Conditions restricts your statutory rights as a consumer. For more details on these statutory rights you should contact your local Trading Standards Office or Citizens Advice, an operating name of the National Association of the Citizens Advice Bureaux.
Nothing in the Terms and Conditions shall exclude or limit the Promoters’ liability for death or personal injury caused by their negligence or for fraud or for any other liability which cannot be limited or excluded by law and the Promoters will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoters or to you at the time of entry to a prize draw or which are caused by a third party.
Information and data that can identify you as a person ("personal data") which is provided by you when you enter a prize draw will be held by the Promoters, and may be used by the Promoters, and their respective service providers, suppliers and contractors for the purposes of administering and fulfilling the prize draw. Entrants agree that this includes without limitation that the Promoters may contact them if there is an issue with the prize draw. Further details of how any personal data will be used are set out below and in the Privacy Notice and entrants agree to this use of their personal data when they participate in the Promoters’ prize draws.
If you are the winner of a prize draw, you agree that the Promoters may post your username on the Site as well as details of the prize.
SPECIAL PROVISIONS ON ACTIVITY-BASED BENEFITS
The Promoters will determine which, if any, benefits a Member is eligible to receive in their sole discretion.
Members can earn COMMUNITY points for participating in certain activities. Members may be offered free entry into prize draws for participating in certain activities (see the ’special provisions on prize draws’ section below).
Once you have collected 1000 COMMUNNITY points (or such other amount as the Promoters decide) they will be converted into Amazon e-vouchers, or general high street e-vouchers, whichever you choose from the selection of e-vouchers made available to you by the Promoters.
The Promoters do not warrant or represent that Members will earn any specific number of COMMUNITY points. The Promoters reserve the right to cease offering COMMUNITY points at any time or to otherwise vary the terms on which COMMUNITY points are accumulated or COMMUNITY points are redeemed upon notice to you.
SPECIAL PROVISIONS ON PRIZE DRAWS
Prize draws sponsored by the Promoters may be made available to Members on the Site. Please see our Privacy Policy for information on how we use your personal data collected from these activities.
Unless otherwise stated in the Specific Terms, the below terms will apply to prize draws made available on the Site:
The Terms and Conditions are available in English only and shall be governed by and construed in accordance with the laws of England and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
